Welcome to G5 Internet ("G5 Internet", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our broadband internet access services ("Service"), including fixed wireless and fiber optic internet, whether residential or business, provided through g5i.net or any related services. By subscribing to, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
G5 Internet provides high-speed broadband internet access via fixed wireless technology (up to 50 Mbps in select areas) and fiber optic technology (up to 1 Gbps where available). Service availability depends on your location, line-of-sight (for wireless), infrastructure, and other factors. We offer month-to-month service with no long-term contracts and no early termination fees. You may cancel at any time, subject to payment of outstanding charges.
2. Eligibility and Account
You must be at least 18 years old (or the age of majority in your jurisdiction) to subscribe. You agree to provide accurate information during signup and to update it as needed. We may suspend or terminate service if information is inaccurate or fraudulent.
3. Billing and Payment
Service is provided on a month-to-month basis.
You will be billed in advance for each monthly period.
Payment is due by the date specified on your invoice.
Accepted payment methods include credit card, check or cash.
Late payments may incur fees (up to the maximum allowed by law).
All prices exclude applicable taxes, regulatory fees, and surcharges, which you agree to pay.
We may change prices with at least 30 days' notice (via email, bill insert, or website posting).
4. No Contract / Cancellation
There are no term commitments. You may cancel service at any time by notifying us (e.g., via phone, email, or account portal). Cancellation is effective at the end of the current billing period unless otherwise agreed. You remain responsible for all charges up to cancellation.
5. Service Characteristics and Performance
Advertised speeds are maximums and not guaranteed. Actual speeds vary based on network conditions, equipment, distance, interference (especially for fixed wireless), device capabilities, and usage.
We may engage in reasonable network management (e.g., congestion management, security measures) to ensure overall service quality. We do not block lawful content or discriminate against applications except as required by law or for network security/management.
No data caps apply at this time, but excessive or abusive usage that impacts the network may result in temporary throttling or suspension.
Service may be interrupted for maintenance, repairs, weather (affecting wireless), or other factors beyond our control. We aim to minimize downtime and will provide notice when possible.
6. Equipment and Installation
We may provide or require use of modem, router, antenna, or other equipment ("Equipment").
Equipment remains our property (or leased); you must return it upon cancellation or pay replacement costs.
You are responsible for installation site preparation (e.g., mounting location for wireless). Professional installation may be available (fees may apply).
You grant us reasonable access to your property for installation, maintenance, and removal.
7. Acceptable Use
You agree not to use the Service for illegal activities, including but not limited to:
Transmitting unlawful content
Spam, phishing, or malware distribution
Hacking, denial-of-service attacks
Copyright/trademark infringement
Excessive automated usage that burdens the network

8. Privacy
We respect your privacy. See our separate Privacy Policy for how we collect, use, and protect your information. We comply with applicable privacy laws.
9. Limitation of Liability
THE SERVICE AND EQUIPMENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS), EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRIOR TO THE CLAIM.
This limitation applies to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify and hold G5, its officers, employees, and agents harmless from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
11. Termination
We may suspend or terminate service for non-payment, violation of Terms, or if required by law. Upon termination, you must pay all outstanding amounts and return Equipment.
12. Changes to Terms
We may update these Terms. We will provide notice (e.g., via email or website) at least 30 days in advance for material changes. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of laws principles. Any disputes shall be resolved in courts located in White County, Arkansas.

15. Entire Agreement
These Terms (together with any separate AUP, Privacy Policy, or service order) constitute the entire agreement between you and G5 Internet regarding the Service.
By using our Service, you acknowledge that you have read, understood, and agree to these Terms.
